AUCTION Terms & Conditions

Statutory Note: 

Items over 100 years old cannot be taken out of India without the permission of the Director General, Archaeological Survey of India, Janpath, New Delhi 110011.

 

Philatelic Zone is by default, the Auctioneer of all items in the Online Auctions.

 

Buyer’s Premium:

There is No Buyer's Premium.

 

Buyer/ Bidder has to pay all applicable Taxes & Charges.

 

Seller’s Commission:

Ten (10%) percent Commission shall be charged from the Seller and also all applicable Taxes & Charges.

 

VAT:

No VAT on Paper Money & Stamps.

2% on Silver & Gold Coins.

5% on other metal items.

Service Tax charged @ …..

 

Auctioneer and Auction:

 

The Auction is conducted by Philatelic Zone (the “Auctioneer”) under these Terms & Conditions and is applicable to Indian Law. Philatelic Zone reserves the right to include its own item(s), material, lot(s) in any Auction sale which may be affiliated or related to companies, principals, officers, employees or any other person.

 

It is strongly recommended by the Auctioneer that if the Buyer/Bidder is present in person at the place of the Auctioneer, he/she should carefully inspect every lot before bidding on it. Buyer/Bidders have to satisfy themselves regarding the accuracy of their purchase, that is, the lot they are bidding on.

 

Buyers must satisfy themselves as to the accuracy of their purchases at the time of delivery. The Auctioneer cannot be held responsible for any discrepancy which might be discovered after the lots have been removed from either the Auction Room or the Auctioneer's premises.

 

The Auctioneer is solely an agent and shall not be held responsible for any default by either buyer or seller or for any action that may arise in respect of any lot(s). Transfer of ownership of any items in the Auction only occurs if the goods are actually sold, that is, first successfully bid on and then paid for.

 

In case of non-payment for any of the lot(s) won by the successful Bidder, the Auctioneer shall possess the absolute right to resell the disputed lot(s).

 

In the event of any dispute, the Auctioneer shall have absolute discretion to determine the dispute and may put up again and re-sell the disputed lot.

 

Under no circumstances will the Auctioneer be liable for any costs, expenses or damages incurred by the Buyer in respect of any lot, including, but not limited to, loss of any kind of profit whatsoever. Bidders are advised to scrutinize the lots they bid for.

Each lot shall be at the Buyer's risk after the fall of the Auctioneer's hammer.

 

Registration:

Each Bidder has to register for the auction and will therefore be required to fill up a registration form with full name, address, contact number and email id. Each Bidder form has to be signed by the Bidder. By filling up the form, the Bidder shall be deemed to have undertaken to fulfill all Terms & Conditions of the Auction and agrees & accepts these terms & conditions of the Auction/Auctioneer. By making a bid, each Buyer acknowledges his acceptance of these conditions and shall be bound by them.

 

Those Bidders who are new to the Auctioneer may be required to furnish Trade references/ identity proof/ refundable deposit prior to the beginning of the auction.

 

While registered Bidders who have fulfilled all the Terms & Conditions are free to bid in person, postal or email. Buy bids will only be accepted from Bidders who are well known to the Auctioneer.

 

Registration Fee is refundable incase the Bidder want to cancel his/her membership.

 

Description/Condition:

All Lots in the auction are shown by either images and/or complete description. For items that are shown by images, the images are part of the description and should take precedence over the written description.

 

Neither the Auctioneer nor the Vendor/Seller is responsible for any error in the description. All images are of the actual items being sold but may not be the actual size, color or to scale. All statements as to the items being sold are statements of opinion only, and are not and shall not be taken to be statements or representations of fact.

 

The Auctioneer reserves the right in forming his opinion or to consult and rely upon any expert or specialist regarded by the Auctioneer as reliable. However, Philatelic Zone (the “Auctioneer”) does not warrant the accuracy of such descriptions.

 

Estimate:

“Start Bid” Price indicates the estimated price of the lot(s) and NO bids below that Start Bid price will be considered.

 

Certification:

Certification is only possible in the following steps:

 

Prior permission is taken by the Buyer/Bidder at least 4 working days before the auction closes/ends and complete payment is made by the winning Bidder/Buyer who has taken prior permission. Once the complete payment is received, the lot shall be handed over to the Buyer/Bidder, that is, the entire certification process is the responsibility of the Buyer and Philatelic Zone (the “Auctioneer”) or Vendor are not responsible in any way. All requisite permission and legal requirements to aid the certification process are the sole responsibility of the Buyer. Also, only certification by Royal Philatelic Society, London or British Philatelic Association, UK, is accepted. If the item is found to be NOT genuine, the Buyer can return the item to the Auctioneer in its original state. Any damaged or altered item shall not be accepted as returned. The item shall then be returned to the Auctioneer and the Buyer will receive a full refund within 15 working days. In all cases, Certification Charges will be borne by the Bidder/Buyer who is asking for such certification whether the item is found genuine or NOT.

 

Bidders:

The winning Bidder is the Buyer of the lot.

 

 In case the Auctioneer feels that any Bidder/Buyer has disputed or not abiding the Terms & Conditions can be Black-Listed from the website & will not be entertained for the future Auctions held by the Auctioneer. Such decisions are the sole discretion, at any time prior to, during, or even after the close of the Auction. Auctioneer reserves the right to Black-List any person from the Auction.

 

If any unit/entity places a bid, then the individual executing the bid on behalf of the unit/entity agrees to personally guarantee payment for any successful bid.

 

A Seller shall NOT be allowed to bid on his own lot.

 

Bidding Options:

By making a bid, the Buyer acknowledges his acceptance of these Terms & Conditions and shall be bound by them.

 

Auctioneer will not be responsible for any errors in bidding (typographical error), so make sure that every bid is entered correctly. Auctioneer will also not be responsible for Internet bids submitted after the published closing time; nor for any Internet delay from the Bidder's/Buyer’s end. 

 

The highest qualified Bidder of any lot(s) recognized by the Auctioneer shall be the Buyer. In the case of a tie bid, the initial bid received or recognized wins. In the event of any dispute between any Bidders at an Auction, Auctioneer may at his sole discretion reoffer the lot. Auctioneer's decision and declaration of the winning Bidder shall be final and binding upon all Bidders.

 

In case of similar bids, given by the room bidders as well as postal/online/email bidders, the purchaser will be the postal/online/email bidder. In case of similar postal/online/email bids, the bid which has been recorded earlier shall qualify.

 

Auctioneer occasionally may experience Internet and/or Server service outages, and Auctioneer may periodically schedule system downtime for maintenance and other purposes, during which Bidders cannot participate or place any bids. If such outages occur, we may at our discretion extend bidding for the Auction.

 

The auctioneer has the right to divide, combine or withdraw lots from the auction without giving reason. The bidding is totally regulated by the Auctioneer. The Auctioneer has full right to refuse any bid(s) or Bidder.

 

All lots are put up for sale subject to any reserve price that may be imposed by the Seller.

 

 

The Buyer of any lot(s) shall immediately notify his name and address to the Auctioneer and if required.
(A) Provide bank or other credit references; and
(B) Pay the full purchase price, or a fractional deposit as may be determined at the discretion of the Auctioneer.

 

In case of full payment for the lot(s) by the Buyer/Bidder, The Auctioneer will not hold himself responsible for the safe custody of any lot(s) left for more than seven (7) working days after the date of sale, and reserves the right to charge storage. The storage facility will only be available for upto 45 days and after that, the Auctioneer/ Seller reserves the right to re-sell the lot(s). The amount remaining after deducting all charges will then be paid to the Buyer/Bidder who looses the lot.

 

In case of part or non payment, any part of the purchase price left outstanding after the closure of the Auction, shall be paid in full within seven (7) days of the date of Auction. Without prejudice to any rights, the Auctioneer reserves the right to charge interest on any due amount including all charges @ 2½ % per month and can re-sell without notice to the Buyer/Bidder.

 

If any Invoice submitted by Auctioneer is not paid in full when due, the unpaid balance will bear interest @ 2½ % per month from the date of invoice until paid. If the Auctioneer refers any invoice to an attorney for collection, the buyer agrees to pay attorney's fees, court costs, and other collection costs incurred by Auctioneer.

 

In any case, if a Winning Bidder fails to pay any amount for the lot(s) he/she has won, Auctioneer reserves all the rights to sell the lot(s) to any under bidders in the Auction that the lot(s) appeared, or relist the lot(s) in a future auction conducted by Auctioneer.

 

Seller shall not be entitled to remove lots from the Auction Room during the course of the Auction.

 

Payments:

Currency of Sale: Indian Rupees.

 

Before making payment, Buyers/Bidders must inspect their purchase(s), the Auctioneer is not responsible for any discrepancy discovered after the closure of the Auction/sale.

 

All winning bidders have to pay for their winning bid/purchase within seven (7) days of closure of Auction/sale. For lots paid after seven (7) days, the Auctioneer reserves the right of charging interest @ 2½ % per month on any due amount.

 

Payment is due immediately upon the close of the Auction. Payment is delinquent and in default if not received in full, in good funds, within seven (7) calendar days of the Auction Sale (the "Default Date"), without exception, time being of the essence. Unless otherwise agreed in writing prior to the Auction Sale, all auction sales are payable strictly in immediately through Bank Transfer/ RTGS/ NEFT/ Demand Draft/ Banker’s Cheque/ Cheque (Payable at Par)/ Paypal. Buyers will be charged all applicable Taxes & Charges……….. (Note: Please don’t deposit cash in any of our Account.)

 

Payments can be made by Cash, Cheque or Demand Draft (favoring SARVESH JAIN payable at JAIPUR). Money can be deposited directly in our SBBJ (State Bank of Bikaner & Jaipur) Bank A/c - 61020473457, Malviya Industrial Area, Jaipur Branch. IFSC Code: SBBJ0010503 (Intimate us payment detail by phone, SMS or email about the same). Buyers are requested to please make sure of total bill amount including commission, taxes, shipping & handling charges before making payment.

 

Any charges incurred in receiving payment i.e. credit card charges, paypal charges, postage due, cheque bouncing charge, etc. have to be borne by the Buyer.

 

A defaulting Bidder agrees to pay for the reasonable costs of resale (including a 10% seller's commission, if consigned to an auction conducted by Auctioneer). The defaulting Bidder's Membership Fee will be forfeited against the commission & if there is any difference in the amount is liable to it to the Auctioneer. The Defaulting Bidder is Black-Listed from the Auction website.

 

Delivery:

Delivery of the lot(s) will be done only when the payments are received in full inclusive of all Taxes & Charges.

Shipping; and Handling Charges:

For Combined shipping discount, contact Philatelic Zone (the “Auctioneer”) before making payment.

 

The Buyers have to pay Shipping & Handling charges for shipping. We always ship through India Post or well known registered couriers, however if our Valued Customers insists on specific courier services; we would be more than glad to oblige, provided the courier cost is borne by Buyer.


All the shippings are at Buyer's risks.

 

Buyer is responsible for Shipping and Handling charges. Lots won will be shipped within 7 days time after the full payment is received. International Bidders shall provide written shipping instructions, including specified customs declarations, to the Auctioneer for any lots to be delivered outside India.

 

NOTE:

Items once sold are non-returnable in any circumstances.

 

Final value of the item shall be the item(s): Closing Price + VAT*+ Service Tax*+ Shipping & Handling charge + Insurance**. All shipping charges will be borne by the successful Bidder. On all Domestic & International shipments, any risk of loss or tampering of the package during the transit will be borne by Buyer/Bidder.

 

Any request for shipping verification for undelivered packages must be made within 15 days of shipment by the Buyer.
